Truck accident leads to death of tow truck driver

On behalf of Jeffrey Frederick of Frederick & Hagle posted in Truck Accidents on Friday, September 25, 2015.

Busy roadways can pose considerable risks to individuals who are traveling and those who may be stopped on the side of the road. Passing vehicles may not give pedestrians or stopped drivers enough space, and an accident could take place. If a truck driver causes a collision, that truck accident could lead to a fatality. In such a case, the victim’s family could file a wrongful death claim.

It was recently reported that an accident in Illinois claimed the life of one individual. Reports stated that a tow truck driver had exited his truck in order to move a vehicle from the side of the road. While in the process, the man was struck by a tractor trailer that was passing by. It was noted that the tow truck did have its flashing lights operating at the time of the incident.

The accident resulted in the tow truck driver suffering fatal injuries, and he was declared dead on scene. The driver of the tractor trailer received a citation for failing to yield to an emergency vehicle and improper lane usage. State police are continuing to investigate the incident, and additional charges could result.

Due to the nature of the truck accident, the family of the deceased victim may wish to consider their legal options. If they feel it could be right for them, filing a wrongful death claim against the driver considered at fault may allow them to pursue compensation. The trucker’s employer may also be named as a defendant. Information on such claims is available from reliable resources and may help to understand the Illinois legal process for this type of action.
