Workers’ Compensation

What to Expect After Filing a Workers Compensation Claim

You or a loved one suffered an on-the-job injury, so, what’s next? The answer is that you should begin the process of obtaining benefits through Illinois’ workers’ compensation system — you do not want to be responsible for the costs of a work-related injury alone.

At Frederick & Hagle, our attorneys have significant experience protecting the rights of injured employees as we guide them through the workers’ comp process. We work hard to see that our clients receive compensation to cover medical costs, replace lost wages and more.

We provide free, no-obligation initial consultations so you can learn about our services and the help we can provide. Please contact Champaign-Urbana law firm online today by calling 217-367-6092 (local) or 1-800-642-1227 (toll free).

The Process

Workers must abide by a strict set of rules as they maneuver through the workers’ compensation process, which includes:

  • Obtaining necessary medical treatment following an injury.
  • Notifying the employer of the injury (within 30 days of the incident).
  • Accurately filling out necessary forms and submitting them to the proper authorities.
  • Obtaining medical proof as to the extent of the injuries, including its impact on your ability to remain gainfully employed or continue working in another capacity.
  • Attending an arbitration hearing at which your claim will be approved or denied.

What If My Claim Was Denied?

Illinois workers’ compensation system is not perfect, unfortunately, and many claims are wrongfully denied each year. When this occurs, we will work quickly to appeal wrongfully denied claims by:

  • Bringing your claim before the IWCC.
  • if denied, appealing to the Circuit Court for review.
  • If denied again, we can take your claim before an appellate court.

It is rare for a case to go beyond the IWCC, but our firm is always prepared to take a case further when our clients are not getting the benefits they deserve.
